1. Agreement to These Terms
These Terms of Service ("Terms") govern your use of the Elizabeth Scott website and your engagement of our wedding photography and videography services (the "Services"). By using this site or booking our Services, you agree to these Terms. Your signed service contract governs the specifics of your event; where these Terms and a signed contract differ, the signed contract controls.
2. Services
Elizabeth Scott provides wedding photography, videography, and combined photo-and-video coverage throughout the United States. Package details, coverage hours, deliverables, and pricing are described at booking and confirmed in your service contract.
3. Booking & Payment
- A date is reserved only upon receipt of a signed contract and the retainer specified in it.
- Promotional offers (including pay-in-full discounts and complimentary engagement sessions) apply only as described at the time of booking and cannot be combined unless expressly stated.
- Remaining balances are due according to the schedule in your contract. Late payments may delay delivery of final galleries or films.
4. Rescheduling & Cancellation
Retainers secure your date and are non-refundable except as required by law or as stated in your contract. If you need to reschedule, contact us as early as possible; we will make reasonable efforts to accommodate a new date subject to availability. Cancellation terms, including any amounts owed for work already performed, are set out in your contract.
5. Deliverables & Timelines
Estimated delivery windows for galleries and films are provided in your contract. Timelines are estimates, not guarantees, and may vary with season and volume. We curate final deliverables at our professional discretion; raw, unedited files are not provided unless expressly agreed in writing.
6. Copyright & Usage License
All photographs and films remain the intellectual property of Elizabeth Scott. Upon full payment, you receive a personal, non-exclusive, non-transferable license to download, print, and share your images and films for personal use. Commercial use requires prior written permission. You agree not to edit, filter, or alter delivered work in a manner that misrepresents it, other than ordinary cropping for personal sharing.
7. Portfolio & Publication
Unless you opt out in writing in your contract, you grant us permission to display selected images and film excerpts from your event in our portfolio, website, social media, and marketing materials.
8. Client Responsibilities
You are responsible for providing accurate event details, obtaining any venue permissions required for photography or videography, and designating a point of contact for the event day. We are not responsible for missed moments caused by venue restrictions, schedule changes not communicated to us, or interference by guests or other vendors.
9. Limitation of Liability
To the fullest extent permitted by law, our total liability arising out of the Services or this website is limited to the amounts you paid to us for the Services. We are not liable for indirect, incidental, or consequential damages. In the unlikely event of catastrophic media failure or our inability to perform, our liability is limited to a refund as described in your contract.
10. Force Majeure
Neither party is liable for failure to perform due to events beyond reasonable control, including severe weather, natural disaster, illness, government restriction, or other emergencies. In such cases we will work with you in good faith to reschedule or provide a substitute of comparable quality.
11. Website Use
Content on this website — including images, films, text, and the Elizabeth Scott name and marks — may not be copied, scraped, or reused without written permission. You agree not to misuse the site or attempt to interfere with its operation.
12. Governing Law
These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles, except where your signed contract specifies otherwise.
13. Changes to These Terms
We may update these Terms from time to time. The effective date above reflects the latest revision. Continued use of the site after changes constitutes acceptance.
